DuPage County Parental Relocation Attorneys
Lawyers for Child Removal and Relocation in Naperville, Wheaton, and Throughout the Area
Thanks largely to the growth of digital technology, the world is more connected than ever. As a result, it is easier for an individual to pursue educational, career, or personal opportunities further away from his or her home. If you are a parent, your decision to move to a new town, state, or country will not only affect your life but that of your child as well. At Calabrese Associates, P.C., we understand the complicated nature of family law cases and assist you in finding a workable solution that suits your best interests, and those of your children.
Helping You Pursue Your Goals
For more than 20 years, our law firm has been working with families to resolve sensitive cases related to divorce, allocation of parental responsibilities (previously known as child custody), child support, and more. You can rely on our attorneys for responsible legal counsel as you look toward building a better future for yourself and your children. If moving a significant distance with your children would help you meet those goals, we will help obtain other parent's approval for the relocation. This may require a new parenting plan, as well as adjusting your allocated responsibilities and parenting time arrangements.
If the other parent does not agree to the proposed relocation, our experienced team will assist you in taking your case to court. By showing that such a move is ultimately in your child's best interest, the court may, upon consideration of all relevant factors, override the other parent's objections and allow you to relocate as planned. An appropriate modification of all relevant orders must then follow to ensure the child's needs continue to be met.
We are also experienced in defending against such relocation where the proposed move would not be in the child's best interests. At Calabrese Associates, P.C. we put the needs of your children first.
Advocates Who Know the Law
Changes to the Illinois Marriage and Dissolution of Marriage Act (IMDMA) have helped clarify what constitutes as a relocation. According to the law, relocation occurs when a parent moves:
- More than 25 miles to a new home in Illinois from a current home in Cook, DuPage, Kane, McHenry, Lake or Will Counties;
- More than 50 miles to a new home in Illinois from current home in any other Illinois county; or
- Move of more than 25 miles to a new home outside Illinois from a current home anywhere in Illinois.
If either parent is considering a move and you are unsure of the steps you should take, we can help you make sense of the law and your responsibilities.
Parental Rights Attorneys Serving Carol Stream and Glen Ellyn
While we are willing to help individuals pursue new opportunities, our attorneys also understand that your rights as a parent are extremely important. If the other parent is looking to move to a new city or state, and you are concerned about the ability to maintain your relationship with your child, we are ready to assist. We help you demonstrate to the court that such a move would place your parent-child relationship in danger and otherwise not be in the best interests of your child.
