A divorce or separation often brings new challenges to parenting. At Calabrese Associates, P.C., we take the rights of parents seriously, and we pride ourselves in helping fractured families negotiate a reasonable parenting time arrangement that allows each parent to play an active role in the child's life. We also have the experience to protect your children from abusive relationships.
Updated Approach to Parental Visitation
For the last several decades, Illinois law presumed that most parents were entitled to reasonable rights of visitation with their children. While the intent of the law was to keep both parents invested in the child's life, it often had the unintended effect of making one parent feel like an interloper or "visitor." Changes to the law have updated the term "visitation" to "parenting time" in order to more accurately reflect the inherent rights and responsibilities of being a parent.
Parenting time considerations are a major component of the allocation of parental responsibilities—formerly called child custody—and a parenting time schedule is expected to be included in negotiated parenting plans. Our attorneys can help you objectively analyze your unique circumstances and develop a parenting time schedule that meets the needs of your child.
Protecting Your Parental Rights
Depending upon your current custody or parental responsibility arrangements, your parenting time may be extremely limited. In some cases, your child's other parent may even be preventing you from exercising your parental rights. Our attorneys are equipped to take action to ensure that you have the appropriate access to your child as required by your existing custody order. If the order needs to be modified due to changing circumstances, we can assist with that process as well.
Illinois Attorneys Dedicated to Your Child's Well-Being
Unfortunately, situations may arise in which you need to act on behalf of your child to prevent long-term or serious harm. If your child's other parent is presenting a physical, emotional, psychological, or moral danger during his or her parenting time, we can work with you in seeking a parenting time restriction. With our help, you can petition the court to place limits on the other parent's time to reduce and eliminate the danger to your child. Although we prefer amicable, negotiated resolutions to division of parenting time, unrestricted parenting time may not always be in the child's best interest. If you believe parenting time with the other parent presents a physical, emotional, psychological, or moral danger to your child, we have the knowledge and experience to seek restriction.
